VACATION RENTAL AGREEMENT

TERMS & CONDITIONS


Guest, Renter, or Tenant shall be referred to as "Tenant," whether singular or plural. The Vacation Rental Property shall be referred to as the "Property." The term "Agent" refers to Salty Escapes LLC, manager working on behalf of Property Owner. The term "Owner" refers to the owner of record of the Property.

HOLD HARMLESS: Tenant agrees to indemnify and hold harmless Agent and the Owner from and against any liability for personal injury or property damage sustained by any person (including Tenant's guests) as a result of any cause, unless caused by negligent or willful act of Agent or the Owner.

ERRORS & OMISSIONS: While the Agent makes every effort to ensure that information published for a Property is current, occasionally we are not fully informed of changes made by the Owner, Association or if changes to the Property have not yet been reflected in Property listings. Tenant understands that the Agent will not be held responsible for such changes, variations, omissions or errors relating to the subject Property.

LEGALLY BINDING: Tenant agrees to abide by and fulfill all parts of this Agreement, all additional published policies, rules, regulations and addenda to this Agreement, and furthermore agrees that it is a legally binding Agreement, either in whole or in part. All parties agree that in the event of a dispute, the Agreement will be interpreted in accordance with Florida law. Should the Agent or Owner be forced to resort to the employment of legal counsel, litigation, or professional collection services in the collection of any amounts due the Agent under this Agreement or defend an action under this Agreement, the Tenant shall be responsible for all costs associated with such.

RULES, REGULATIONS & POLICIES: By signing the Vacation Rental Agreement, the Tenant certifies that he/she has read, understands, and will abide by all rules, policies, regulations of the Agreement. Agent and those peculiar to the subject Property, including but not limited to any and all Home Owner's Association rules and fees, and all City, County, and State ordinances. Additional policies may be posted at the Property or included in email communications from the Agent. Tenant understands and agrees that failure to abide by the above stated may result in imposed fees and/or eviction.

RESERVATIONS: Any balance due is due 30 days prior to your arrival date. No checks will be accepted. Reservations made within 30 days of the arrival date must be paid in full. Agent accepts all major credit cards.

TAXES: All taxes are at the rates applicable at the time of the Agreement. Taxes will be disbursed to the taxing bodies, i.e. Florida Department of Revenue and local County authorities. The tax rates may change without notice and increases will be the responsibility of the Tenant.

CHECK-IN: Check-in begins after 4:00 p.m. CST on {reservations.startdate}. All properties are self check-in by way of electronic door code which will be provided 3 days prior to your arrival. Door codes will become active once the Property has been confirmed ready for guest check-in. Agent will make every effort to ensure all properties are clean and ready for occupancy by 4:00 p.m. CST. Please do not go by the Property prior to check-in time unless an early arrival has been granted by the Agent. In unusual emergency circumstances it may be necessary to delay occupancy beyond 4:00 p.m. CST to ensure that the Property is prepared to reasonable standards. Agent is responsible to notify Tenant of any delays in normal check-in times as soon as it becomes known that the Property will not be ready. Agent will grant Tenant amenity access and provide recommendations for nearby activities until Property is ready for check-in.

CHECK OUT: Check-out time is no later than 10:00 a.m. CST on {reservations.enddate}. A $75 per hour fee will be charged to Tenant for any occupancy period extended past the designated check-out time. Agent kindly asks that Tenant follows the check-out procedures listed below.
  • Start dishwasher cycle
  • Place all dirty towels in bathtub or shower floor
  • Leave sheets and bedding on all beds- housekeeper will remove and replace with clean bedding during the departure clean process
  • Report any damages or maintenance issues immediately to give Agent ample time to correct issues before the next guest arrival
  • Dispose of all trash in the designated trash location of the Property
  • Return all furniture and housewares items to their original location
  • Turn the AC to 78 degrees (or heat at 55 in winter months)
  • Inspect the Property thoroughly for any personal items
  • Secure all windows/doors and turn off all lights
CANCELLATIONS BY TENANT: Should Tenant have to cancel for any reason, the Tenant must notify Agent in writing immediately by email to info@saltyescapes.com. Tenant acknowledges that cancellation by the Tenant does not release the Tenant from the specific terms of this Agreement. Failure to cancel in writing may result in charging the final payment to the Tenant's credit card. Cancellation terms may vary based on where the reservation was generated. Any reservations made directly with the Agent are subject to the below cancellation terms. If reservation was made on a third-party booking site, Tenant is subject to the specific cancellation terms listed on the site the reservation was generated from. Agent will not be responsible for reimbursing any third-party fees. Tenant must seek reimbursement directly from the third party if applicable. Tenant is responsible to verify that the cancellation notification has been received by the Agent.

AGENT DIRECT BOOKING CANCELLATION TERMS:
  • Short Term Reservations (30 days or less): Full refund to Tenant if written cancellation is received more than (60) days before date of scheduled arrival. NO refunds if canceled less than (60) days before date of scheduled arrival.
  • Extended Stay Reservations (31 days or more): Full refund if canceled more than (120) days before date of scheduled arrival. NO refunds if canceled less than sixty (120) days before date of scheduled arrival.

CANCELLATIONS BY THE AGENT: If the Property becomes unavailable prior to your occupancy, the Agent will make every effort to substitute a reasonably comparable Property. Agent will notify Tenant of this circumstance as soon as Agent is made aware of an occupancy issue. If Agent is unable to substitute a reasonably comparable Property, the Agent will refund 100% of Tenants advance rental payments. Agent reserves the right to automatically cancel a reservation if payment is not paid in full 30 days prior to arrival. In such event, all payments made by the Tenant to the Agent will be refunded, and neither the Agent nor the Owner will be liable for any damages of any sort incurred by Tenant as a result of such cancellation. If Tenant desires to be transferred to alternative premises, the Agent will make a good faith effort to relocate the Tenant to a reasonably comparable Property. In such case, the Tenant agrees to pay any increase in rental charges associated with the new Property.

FAMILY GROUPS ONLY: The Agent's authority is restricted to rental to family groups only. House parties, fraternities, school, civic or other non-family groups are NOT allowed unless prior approval is received from the Agent. Weddings, wedding receptions and other group events may not be held on the Property without prior approval of the Agent. The Agent reserves the right to refuse rental to groups where the majority of the occupants are under age 25 (ID's must be furnished upon request).

MAXIMUM OCCUPANCY: Tenant is responsible for respecting the max occupancy of the Property. If this legal occupancy limit is exceeded, Tenant may lose rental rights and be subject to eviction.

REFUNDS POLICY: Agent will make every effort to ensure that Tenant's stay is safe, comfortable and enjoyable. Agent cannot guarantee that the Tenant's vacation stay or Property is flawless. However, Agent will make reasonable efforts to respond to any reported deficiencies and malfunctions in the Property and its amenities. Tenant understands and agrees that NO refunds, discounts, or transfers will be made for any reason other than those specifically provided for in this Agreement. Additionally, Tenant agrees that NO refunds, discounts, or transfers will be granted for the malfunction of any appliance, electronics, wifi, inclement weather, dislike of Property decor, mechanical breakdowns, or any other adverse circumstances beyond our control. Tenant understands and agrees that it is Tenant's responsibility to ensure that all aspects of the Property meet their personal standards prior to confirming the reservation through carefully reviewing Property listing photos and details. NO refunds, discounts, or transfers will be considered in such cases. Tastes, opinions, standards of living and other expectations vary greatly from person to person.

REPORTING ISSUES: Tenant agrees to report any and all issues and Property damage to Agent immediately upon discovery. The Agent agrees to make every effort to resolve the reported issue as quickly as possible, however, Agent cannot guarantee when or if the issue will be resolved. Tenant understands and agrees that emergency repair and service calls will be returned promptly and that the urgency of any problems and its resolution will be solely determined by the Agent. Calls deemed to effect non-essential services will be returned the following business day. In cases of medical or fire emergencies the Tenant will call 911 emergency services.

PERSONAL PROPERTY: Agent will not be held responsible for personal property during your stay or any items left behind following Tenants' departure. Tenant must immediately report any suspected item(s) that may have been left behind. Personal items found in the Property will be turned into the local UPS store as part of their ‘Resort Drop-Off Program'. A UPS staff member will then reach out to Tenant directly to arrange shipping and payment details. Unclaimed items are donated to charity after 3 unsuccessful attempts to reach Tenant.

PETS: Properties allowing pets are limited to housebroken domestic animals. The rental rate will increase by at least an additional $250.00 per pet as a non-refundable fee on all reservations allowing a pet. Tenant agrees to disclose the breed, weight, and condition of each pet and agrees that the Agent may refuse to allow pet occupancy on any of these grounds. A pet of any kind on the premises including exterior, decks, garages, etc. of a non-pet friendly Property is absolutely prohibited and is grounds for eviction. Tenant understands and agrees that a violation of the pet policy will result in fees for any and all costs associated with pest control, carpet cleaning or replacement and furniture cleaning or replacement. Under no circumstances shall the Tenant be relieved of responsibility for damages caused by pets, irrespective of additional fees rendered for the privilege of bringing a pet.

SMOKING: All properties are non-smoking. Any and all costs associated with removing smoke odor or damage will be at the expense of the Tenant. Smoking may be prohibited on balconies for specific condo associations and additional fees may be charged to Tenant if found in violation. All cigarette ashes and butts should be disposed of properly and not be thrown in the yard, over balconies or anywhere else around the Property.

LINEN & TERRY: All properties provide linen and terry (sheets and bath towels) for the rental period based on occupancy of the Property. Beds will be supplied with pillows and bed spreads. Beach towels are not provided. Linen and terry included with the Property may not be taken outside of the Property or used for any other purposes outside of their normal use. Black makeup cloths are provided in each bathroom. Any and all damages caused to the linens or terry may be charged to the Tenant for replacement costs.

POOLS & HOT TUBS: Most pools and hot tubs are open year-round unless maintenance, repairs or weather create a need for closure. Opening/closing dates are subject to change without notice and without recourse or refund. Pools and hot tubs are to be used strictly at Tenants own risk. Tenant releases the Agent/Owner from all liability for any injuries, death or illness resulting from use of pool or hot tub. Pets are not permitted in pools or hot tubs.

GRILLS: If a grill is present and functional at the Property, Tenant is responsible for suppling grilling utensils, propane, charcoal and lighter fluid if needed. Tenant is responsible to thoroughly clean grills upon departure. Agent may charge Tenant for any additional cleaning fees.

PARKING: The number of available parking spaces will vary according to the Property. Specific parking instructions will be included in your ‘Arrival Instructions’ email sent prior to your arrival date. Many resort properties have restrictions for campers, boats, trailers, etc. Please contact Agent prior to arrival to make arrangements for specialty items as such.
